ACCEPTANCE OF OUR LEGAL TERMS

We are Klimra AB, a company registered in Sweden with the address Drömstigen 41, Stockholm, 16761 Stockholm.

We operate the website https://www.klimra.com, as well as all other related products and services that refer or link to these legal terms.

These legal terms constitute a legally binding agreement between you and Klimra AB. By accessing the services you agree to be bound by these legal terms. If you do not agree, you must discontinue use.

We will provide prior notice of planned changes to the services you are using. By continuing to use the services after the effective date of any changes, you agree to be bound by the revised terms.

The services are intended for users at least 16 years old. Persons under 16 are not permitted to use or register for the services.

Our services

The information provided in connection with the use of the services is not intended for distribution or use by any person or entity in any jurisdiction or country where such distribution or use would violate law or regulation, or where it would subject us to any registration requirement in such jurisdiction or country. Consequently, those who choose to access the services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

Intellectual property rights

Our Intellectual Property

We are the owner or licensee of all intellectual property rights in our services, including all source code, databases, functionality, software, website design, audio, video, text, photographs, and graphics in the services (collectively "the Content"), as well as the trademarks, service marks, and logos contained therein ("the Marks").

Our content and marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and worldwide.

The content and marks are provided in or through the services "AS for your personal, non-commercial use or internal business purposes only.

Your Use of Our Services

Subject to your compliance with these legal terms, including the section "PROHIBITED ACTIVITIES" below, we grant you a non-exclusive, non-transferable, revocable license to:

  • Access the services; and
  • Download or print a copy of any portion of the content to which you have properly gained access.

This is solely for your personal, non-commercial use or internal business purposes.

Except as expressly stated in this section or elsewhere in our legal terms, no part of the services and no content or marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.

If you wish to use the services, content, or marks in a manner other than as set out in this section or elsewhere in our legal terms, please contact us at contact@klimra.com. If we grant you permission to publish, reproduce, or publicly display any part of our services or content, you must identify us as the owner or licensee of the services, content, or marks and ensure that all copyright or proprietary notices are displayed or visible when publishing, reproducing, or displaying our content.

We reserve all rights not expressly granted.

Any breach of these intellectual property rights will constitute a material breach of our legal terms and your right to use our services will terminate immediately.

Your Submissions

Please review this section and the "PROHIBITED ACTIVITIES" section carefully before using our services to understand (a) the rights you grant us, and (b) your obligations when you post or upload content through the services.

Submissions: By directly submitting questions, comments, suggestions, ideas, feedback, or other information regarding the services ("Submissions") to us, you agree to assign to us all intellectual property rights in such Submissions. You agree that we shall own this submission and shall be entitled to its unrestricted use and dissemination for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

You are responsible for what you post or upload: By sending us Submissions through any part of the services:

  • You confirm that you have read and agree to our "PROHIBITED ACTIVITIES" and will not post, send, upload, or transmit any submission that is illegal, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, threatening to any person or group, sexually explicit, false, inaccurate, fraudulent, or misleading;
  • To the extent permitted by applicable law, you waive all moral rights to such submissions;
  • You warrant that all such submissions are your original creation or that you have the necessary rights and licenses.
  • You warrant and represent that your submissions do not constitute confidential information.

You are solely responsible for your submissions and agree to reimburse us for any losses resulting from your breach of this section, third- party intellectual property rights, or applicable law.

User representations

By using the services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these legal terms; (4) you are not a minor in the jurisdiction in which you reside; (5) you will not access the services through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the services for any illegal or unauthorized purpose; and (7) your use of the services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the services (or any part thereof).

By using the services, you agree that all information you provide during registration and any submissions made, including but not limited to claims for compensation, will be true, accurate, current, and complete. Providing false information may result in the suspension or termination of your account and legal liability.

User registration

You may be required to register to use the services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate or objectionable.

Prohibited activities

You may not access or use the services for any purpose other than that for which we make the services available. The services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

As a user of the services, you agree not to:

  • Systematically retrieve data or other content to create a collection or database without permission.
  • Deceive, defraud, or mislead us or other users.
  • Circumvent or interfere with security-related features.
  • Disparage, tarnish, or otherwise harm us and/or the services.
  • Use any information obtained to harass, abuse, or harm another person.
  • Misuse support services or submit false reports of abuse.
  • Use the services in a manner inconsistent with applicable laws.
  • Upload or transmit viruses, Trojan horses, or other harmful material.
  • Engage in any automated use of the system.
  • Remove copyright or proprietary rights notices from any content.
  • Impersonate another user or person.
  • Interfere with or create an undue burden on the services.
  • Harass, annoy, intimidate, or threaten our employees or agents.
  • Attempt to bypass access restriction measures.
  • Copy or adapt the services' software.
  • Reverse engineer any software comprising the services.
  • Use or launch any unauthorized automated system.
  • Make unauthorized use of the services or create accounts under false pretenses.
  • Use the services to compete with us or for commercial enterprise.
  • Use the services to advertise or offer to sell goods and services.
  • Sell or transfer your profile.

User-generated contributions

The services do not offer users the opportunity to submit or post content.

Contribution license

You and the services agree that we may access, store, process, and use any information and personal data that you provide following the terms of the privacy policy and your choices (including settings).

By submitting suggestions or other feedback regarding the services, you agree that we can use and share such feedback for any purpose without compensation to you.

Management of services

We reserve the right, but not the obligation, to monitor the services; take appropriate legal action; refuse, restrict or disable access; remove files that are excessive in size; and otherwise manage the services to protect our rights and property and to facilitate proper functioning.

Privacy policy

We care about data privacy and security. Please review our Privacy Policy: klimra.com/privacy-policy. By using the services, you agree to be bound by our Privacy Policy.

The services are hosted in Sweden. If you access the services from another region with different laws, through your continued use you consent to have your data transferred to and processed in Sweden.

Terms and termination

These legal terms shall remain in full force and effect while you use the services. We may deny access to any person for any reason, including for breach of these legal terms or applicable law.

If we terminate or suspend your account, you are prohibited from registering a new account under your name or a third party's name. We may also take appropriate legal action.

Modifications and availability

We reserve the right to change, modify, or remove the content of the services at any time without notice. We will not be liable for any modification, price change, suspension, or discontinuance.

We cannot guarantee the services will always be available and may need to perform maintenance, resulting in interruptions. We have no liability for any loss caused by such downtime or interruption.

Applicable law

These legal terms are governed by and interpreted in accordance with Swedish law. If you are an EU consumer, you also have the protection of the mandatory provisions of the law of your country of residence.

Dispute resolution

The European Commission provides an online dispute resolution platform that you can access. If you would like to bring this topic to our attention, please contact us.

Corrections

There may be information about the services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any such errors and to change or update information at any time.

Disclaimer

The services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties.

Limitations of liability

In no event shall we or our directors, employees, or agents be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages arising out of your use of the services.

Indemnification

You agree to indemnify and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the services or your breach of these legal terms.

User data

We will retain certain information you transmit to the services for performance management and information related to your use. You are solely responsible for any data you transmit. We have no liability for any loss or corruption of such data.

Electronic communications, transactions and signatures

You agree to receive electronic communications and that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communication be in writing.

Service-Specific Terms - Klimra Taxi

Klimra Taxi - Terms of Service

1. Who we are

These Terms of Service ("Terms") are between you and Klimra AB ("Klimra", "we", "us").

2. Acceptance of these Terms

By creating an account, accessing, or using Klimra Taxi (the "Service"), you agree to these Terms. If you do not agree, you must not use the Service.

These Klimra Taxi Terms apply specifically to the Klimra Taxi service. Your use of Klimra's platform is also governed by Klimra's general Terms of Service ("General Terms") available at klimra.com/terms-of-service. If there is any conflict between these Klimra Taxi Terms and the General Terms, these Klimra Taxi Terms will apply to the extent of the conflict for matters relating to Klimra Taxi.

We may update these Terms from time to time. If changes are material, we will provide reasonable notice. Your continued use after the effective date means you accept the updated Terms.

3. The Service (Klimra Taxi)

Klimra Taxi enables users to request and take a taxi to reach their intended destination when a qualifying train delay occurs for short-distance trips (below 150 km), through our taxi partner(s).

Important: Klimra is a technology and administration provider. Klimra is not a taxi carrier and does not perform transportation services. The taxi ride is provided by the Taxi Partner.

4. Eligibility and account

  • You must be at least 16 years old to use the Service.
  • You must provide accurate and up-to-date information.
  • You are responsible for all activity under your account and for keeping access credentials secure.

5. Definitions

  • "Train Trip": the train journey you confirm when booking.
  • "Qualifying Delay": a delay that meets the eligibility criteria shown in the Service at the time you request a taxi.
  • "Short-distance": a trip under 150 km, as confirmed by Klimra.
  • "Taxi Cap": a maximum covered amount of SEK 1,470 per approved taxi request, unless otherwise stated in the Service.
  • "Taxi Request": a taxi booking request made through Klimra Taxi.

6. How Klimra Taxi works

  • You select/confirm your Train Trip and request a taxi through Klimra.
  • Klimra assesses eligibility (e.g., distance threshold, delay status, and other criteria shown in the Service).
  • If approved, the Taxi Partner may accept and perform the ride.
  • Payment handling and any user charges follow Section 9 and the Klimra Payment Terms (its a document).

7. Eligibility rules and acceptable use

7.1 Core eligibility (must be met)

A Taxi Request is eligible only if:

  • The Train Trip is short-distance (under 150 km); and
  • The Train Trip has a Qualifying Delay (as shown in the Service at the time of request); and
  • The taxi is requested through Klimra Taxi (external bookings are not immediately covered); and
  • The taxi route is to your intended destination for the Train Trip (or another permitted drop-off shown in the Service); and
  • You comply with instructions (e.g., verification steps, pickup location, time window).

7.2 The Taxi Cap (SEK 1,470)

Klimra Taxi covers taxi costs up to SEK 1,470 per approved Taxi Request (the "Taxi Cap"), unless stated otherwise.

If the total taxi fare exceeds the Taxi Cap, you may be required to pay the difference (see Section 9).

7.3 Fees that may fall outside the Taxi Cap

Depending on circumstances and the Taxi Partner's rules, the following may be charged to you (even if the ride is otherwise eligible):

  • cancellation fees or no-show fees
  • waiting-time fees if you are late to pickup
  • additional stops or detours not required to reach the permitted destination
  • damage, cleaning, or misconduct-related fees
  • other mandatory surcharges (if applicable)

7.4 Prohibited use

You may not use Klimra Taxi:

  • for trips unrelated to the delayed Train Trip
  • to a non-permitted destination
  • to manipulate eligibility (false tickets, times, locations, or any fraud)
  • in a way that violates law or these Terms

We may deny eligibility, reverse coverage, charge you for costs incurred, suspend access, and/or terminate your account in case of suspected misuse.

8. Taxi Partner services and your relationship with the Taxi Partner

8.1 Transportation is provided by a third party

The taxi ride is provided by the Taxi Partner. The Taxi Partner is responsible for the driver, vehicle, and transportation.

8.2 Complaints, lost items, safety incidents

Issues relating to the taxi ride itself (e.g., driving, vehicle condition, safety, lost property) should primarily be addressed with the Taxi Partner. Klimra may assist by providing booking references or contact guidance.

9. Pricing, billing, and payment (Taxi)

9.1 Payment handling

Klimra pays for the cost of the taxi trip, except for the service fee you pay when making a booking, as described in the Klimra Payment Terms.

9.2 Your responsibility for amounts beyond coverage

You authorize Klimra to charge your payment method for:

  • fees outside the Taxi Cap (Section 7.3)
  • chargeback/administration costs in case of wrongful disputes, where permitted by law
  • amounts exceeding the Taxi Cap, if applicable

10. Availability and changes

Klimra Taxi may be limited by geography, time, partner capacity, technical constraints, and eligibility rules. We do not guarantee availability, acceptance by the Taxi Partner, or pickup times.

11. Intellectual property

All rights in the Service, including software, designs, trademarks, and content, belong to Klimra. You may not copy, reverse engineer, or misuse the Service.

12. Privacy

We process personal data according to our Privacy Policy: klimra.com/privacy-policy.

To enable a taxi ride, we may share necessary data with the Taxi Partner (e.g., name/phone, pickup/drop-off, booking identifiers).

13. Disclaimers

The Service is provided "as is" and "as available". Klimra does not guarantee:

  • that you will qualify for a Taxi Request
  • that a Taxi Partner will accept a request
  • that the taxi ride will be uninterrupted, timely, or error-free

Nothing in these Terms limits mandatory rights under consumer protection law.

14. Limitation of liability

To the maximum extent permitted by law:

  • Klimra is not liable for the taxi transportation itself (a third- party service).
  • Klimra is not liable for indirect losses (e.g., lost profits, missed connections, consequential damages).
  • Klimra's total liability for claims relating to the Service will not exceed the amount you paid to Klimra (if any) for the relevant Taxi Request in the last 3 months, unless mandatory law requires otherwise.

15. Indemnity

You agree to indemnify and hold Klimra harmless from claims, damages, and costs arising from your misuse of the Service, breach of these Terms, or unlawful conduct.

16. Termination

You may stop using Klimra Taxi at any time. We may suspend or terminate access if you breach these Terms, misuse the Service, or if required for security/legal reasons.

17. Governing law and disputes

These Terms are governed by Swedish law. Disputes shall be resolved by Swedish courts. Consumers may also use ARN (Allmänna reklamationsnämnden) where applicable.

Klimra – Payment Terms

Klimra – Payment Terms

These Payment Terms apply to payments, fees, billing, and payouts related to Klimra services, including (i) Klimra's compensation service for delayed trains ("Compensation Service") and (ii) Klimra Taxi ("Taxi Service"). They form part of the applicable terms you accept when using Klimra.

1. Currency

All amounts are stated in SEK unless otherwise specified.

2. Definitions

  • "Klimra Fee": the service fee charged by Klimra for the Compensation and Taxi Service.
  • "Recovered Compensation": amounts paid out by a carrier/liable party in relation to your train delay claim.
  • "Taxi Cap": SEK 1,470 maximum coverage per approved Taxi Request (unless otherwise stated).
  • "Covered Amount": the portion of a Taxi Partner fare covered by Klimra under Taxi Service rules.
  • "User Payable Amount": amounts you must pay (e.g., no-show fees, ineligible rides).

3. Compensation Service – fees and payouts

3.1 Klimra Fee model

Klimra will charge a Klimra Fee of 29 SEK as a compensation claim is approved by the train company. This is clearly explained to the customer when creating an account and filling in the payment details. If no compensation is recovered, Klimra charges no Klimra Fee. When using the Taxi Service a Klimra Fee of 49 SEK will be charged when the customer approves the booking of the taxi and a taxi request has been filed by Klimra.

3.2 How payouts are handled

In the compensation service, the compensation amount will be paid directly to you from the train company. Klimra will then automatically charge 29 SEK from the payment details specified when creating an account.

In the Taxi Service, the payment of 49 SEK will be paid upon confirmation from the user. Klimra then pays for the Taxi service and no other payment is needed from the customer.

3.3 Payout timing

Klimra aims to handle the claims as quickly as possible and as soon as the compensation claim is made, the time until the money arrives to the customer depends on the specific train company's handling time.

4. Taxi Service – coverage and billing

4.1 Covered Amount

For approved Taxi Requests, Klimra covers the Taxi Partner fare up to the allowed cap from public transportation companies (SEK 1,470).

4.2 User Payable Amounts (you may be charged)

You may be charged for:

  • amounts exceeding the Taxi Cap
  • cancellations, no-shows, late arrival to pickup, or waiting-time fees, stating false information, misuse of the Taxi service
  • damage/cleaning fees or misconduct-related fees
  • extra stops or detours not permitted

5. Payment methods

You must maintain a valid payment method when required. Accepted methods include payment cards and other methods shown in the Service.

Klimra may use third-party payment processors. Your bank/card issuer may apply its own fees.

6. Receipts and invoices

The user receives receipts and transaction confirmations via the email used for the account making the booking in the Taxi service.

7. Corrections, refunds, and disputes

7.1 Billing issues

If you believe a charge is incorrect, contact Klimra within 30 days of the charge date and provide all necessary information.

7.2 Chargebacks

If you initiate a chargeback with your bank, Klimra may suspend your access to the Taxi Service while the dispute is investigated. If the chargeback is found to be wrongful, you may remain liable for the amount and reasonable administrative costs where permitted by law.

7.3 Refunds

Refund eligibility depends on the reason (e.g., duplicate charge, system error, partner cancellation). If approved, refunds are made to the original payment method where possible.

8. Failed payments and collections

If a payment fails, Klimra may:

  • retry the charge
  • request an alternative payment method
  • suspend access to parts of the Service
  • pursue collection in accordance with Swedish law (including reminder and collection fees where permitted)

9. Promotions and credits

Promotions, credits, or special coverage rules apply only under the conditions shown when offered and may be time-limited or capacity- limited.

10. Changes to these Payment Terms

We may update these Payment Terms. Material changes will be communicated with reasonable notice. Continued use after the effective date means you accept the updated terms.
